This Privacy Statement outlines how CHS & Partners ("we," "us," or "our"), as the Data Controller under the Thai Personal Data Protection Act B.E. 2562 (2019) (PDPA), collects, uses, maintains, and discloses personal data collected from users (each, a "Data Subject" or "User") of the www.chsthailand.com website ("Site").

• Lawful Basis for Processing: CHS & Partners relies on the following primary legal grounds for processing your data:

  • Consent (Section 19): Where you have given your free, specific, informed, and unambiguous consent, such as opting in to a newsletter.

  • Contract (Section 24(3)): Where processing is necessary for the performance of a contract to which you are a party (e.g., providing legal services) or to take steps at your request prior to entering into a contract.

  • Legitimate Interest (Section 24(5)): Where processing is necessary for our legitimate interests (e.g., website security, general administrative purposes), provided that such interests are not overridden by your fundamental rights.

  • Legal Obligation (Section 24(6)): Where processing is necessary for compliance with a law to which CHS & Partners is subject.

3. Purpose and Retention Period

• Responding to Inquiries (Contact form submissions) > Contract or Legitimate Interest > Kept only as long as necessary to resolve your inquiry, typically 6 months.

• Sending Newsletters/Marketing > Consent > Kept until you withdraw consent (unsubscribe).

• Website Security & Analytics > Legitimate Interest > 1 year for analytical and security logs.

• Establishing Legal Claims > Legal Obligation (Defence of Claims) > Retained for the period required by relevant Thai laws (e.g., Civil and Commercial Code).

• Right to Withdraw Consent: To withdraw your consent at any time, provided that there is no other lawful basis for us to continue processing. (Section 19)

• Right to Lodge a Complaint: To file a complaint with the Personal Data Protection Committee (PDPC) if you believe CHS & Partners has failed to comply with the PDPA.

5. Disclosure and Cross-Border Transfers

• Disclosure: CHS & Partners will not disclose your Personal Data to third parties except as necessary for the stated purposes, with your consent, or when required by law. This may include disclosing data to our service providers (data processors) who assist us in website operation, provided they are bound by a contract that upholds PDPA standards.

• Cross-Border Transfer (Section 28): In the event your Personal Data is transferred outside of Thailand, CHS & Partners will ensure that the destination country or international organization has an adequate data protection standard as prescribed by the PDPC, or that the transfer falls under an allowed exemption (such as for the establishment of legal claims or with your explicit consent).
